A Tennessee judge has set a date for the retrial in the Vanderbilt rape case,according to the Associated Press.
Brandon Vandenburg and Cory Batey will stand trial on April 4 in Nashville. A judge granted a request to delay the retrial last week when Vandenburg’s new defense team requested more time to prepare for the case.
Vandenburg and Batey were convicted in January of raping a Vanderbilt student in a campus dorm room in 2013. The verdict was thrown out in June when a judge declared a mistrial due to juror misconduct. The two men’s lawyers successfully motioned for the judge to declare a mistrial because the foreman of the 12-person jury did not disclose that he was the victim in a statutory rape case 15 years ago.
