Police: Ind. man shot marshal before being killed

By Dominic Adams Fort Wayne Journal Gazette FORT WAYNE, Ind. — Federal agents knew Marcus Hayden was in an apartment in the 1300 block of Greene Street late Monday, and they moved in to arrest him.

After announcing their presence and demanding he come out, police broke down the door about 11:30 p.m. and gunfire erupted. Hayden shot a U.S. marshal trying to arrest him before a city officer shot Hayden. He later died at a hospital, officials said.

U.S. marshals and agents with the Bureau of Alcohol, Tobacco, Firearms and Explosives were serving a warrant accusing Hayden of failure to appear in federal court. Fort Wayne police officers acted as backup.

Officers knocked on the door in Eden Green apartments and announced their presence multiple times. When police entered the apartment, Hayden started shooting at them from the hallway with his 9 mm handgun, according to Indiana State Police.

An unidentified marshal was shot in the lower right leg, but the injuries were not life-threatening. He has undergone two surgeries as a result of the gunshot wound, state police said.

Dozens of police cars with city, county and state officers swarmed to the south-side apartment complex, blocking every exit and cordoning off a large part of it with police tape.

The massive police response came after dispatchers broadcast an "officer down" call. "That's a call we never want to hear in law enforcement," Fort Wayne Police Chief Rusty York said Tuesday.

After shooting the U.S. marshal, Hayden then jumped out of a first-floor window with a handgun in his possession and was met by an unidentified Fort Wayne police officer. The officer ordered Hayden multiple times to drop the gun, but Hayden verbally refused, state police said.

York said the officer then shot Hayden in the torso with a shotgun. The officer is a veteran of the Fort Wayne police gang unit.
